2024-25 Contract
This agreement is entered into by and between you (referred to as the Client) and Liberty Lawn and Snow, LLC (referred to as the Contractor) for snow removal services at the Client's property located at your property (referred to as the Property).

Contract Period: November 1, 2024 – March 31, 2025
​
NEW FOR 2024-25 CHRISTMAS CLAUSE: In order to give our employees the opportunity to spend time with family Liberty reserves the right to pause services:

Christmas Eve from 1600hrs to 0000hrs (midnight).

Christmas Day and 0600 to 1200hrs. (noon)
Unlimited Service Visits: No service visit cap. Our snow removal contracts offer unlimited visits within the contract dates.
Snowfall Trigger: 1.5” Contractor will provide service when the snowfall trigger is met. The snowfall trigger is defined as the total amount of new snow accumulation during a single snowfall event. If the accumulated snow does not reach or exceed the trigger depth, services will not be initiated. Snowfall is measured per event by the contractor at various locations within the service area, at pavement level, excluding snow drifts. Individual property measurements are not practical or necessary. Multiple snow events that produce accumulations less than the trigger cannot be combined to qualify for a triggered service. Client is responsible for maintaining their property between snowfalls of 1.5" inches.

Unlimited Snow Totals: There is no cap on amount of snow to be included in contract range.

Snow Removal Services: Contractor will begin snow removal services once snowfall has ceased or reached a total accumulation of 6" inches. We will strive to complete rounds of service for every 6 inches of snow. Please understand that the duration of the storm may affect the time required to complete service. We guarantee driveway service within 16 hours of snowfall cessation. Typically, routes are completed within 6-8 hours. Contractor is not responsible for snow drifting that may occur after service. We are also not responsible for snow left behind by city plows under snow totals of 6" of accumulation. If the city plow deposits excessive snow (an uncommon occurrence), we can remove it for an additional $50 per incident. Callbacks to remove snow resulting from vehicles parked in the driveway will be billed at a minimum rate of $50 per occurrence.

Shoveling: Hand shoveling of garage aprons and walkways is not included
​
Signage Requirement: To ensure timely snow removal, we require a 4"x 4' sign to be placed along your driveway for the entire snow removal season. This sign helps our drivers locate your property during snowfalls and as they familiarize themselves with their routes. Please note that this is a mandatory requirement, and services will not be provided without the sign.

Snow Stake: Unless the Client has signed up for the contractors Snow Staking service, the Client is responsible for driveway snow staking. We require you to use flexible fiberglass snow stakes to stake your property. Electrical boxes, light posts, water mains, and other such structures must be staked out by the Client, even if driveway staking was contracted. ​
Out- of -Contract Snow Removal: In the unlikely event snow removal is required outside the contract period, a discounted rate of $40 per visit will apply. It's important to note that we've only needed to provide out-of-contract snow removal three times in the past 15 years. October and April snowfalls usually melt within a few days. Services performed outside the contract dates or scope are still subject to the terms of this contract.

Salting Services: Contractor may determine that salting services are necessary. If this occurs, the Client will be charged, a fee of $60. We have only mandated salting once in the past 15 years.

Invoicing & Payment - Card on File: All residential clients must place a credit card on file for payments.
Contract Invoicing: Your card will be charged before the start of your contract. A paid invoice will be emailed to you.
Outside of Contract Invoicing: Your credit card will be charged, and a paid invoice will be emailed to you following the service visit.
Invoice Due Date: Invoices are due upon receipt or before the start of the contract.
Past Due Accounts: Contractor reserves the right to suspend services until full payment is received. Overdue bills may be referred to a collection agency or legal action may be taken. In the event of client default or legal action, the Client agrees to reimburse the Contractor for all administrative costs, legal fees, and associated expenses.

Limitations of Liability: Contractor will exercise reasonable care to avoid damage to pavement, curbs, trees, shrubs, fire hydrants, and watering systems. Before a snow event, all vehicles must be cleared from driveways. Contractor will make every effort to avoid plowing within 3 feet of parked cars. However, Contractor is not responsible for: Damage to items that are snow-covered or not visible. Damage to irrigation heads. Owners are responsible for ensuring sprinkler heads are properly seated in the ground before the winter season. Items left on driveways, walkways, or steps. These areas must be completely clear. Damage to downspouts, planters, basketball hoops, or other items within the driveway area. These items should be removed for the winter. Damage to other items that the Contractor requested to be removed but were not by the Client. Damage to turf, landscaping, or irrigation components caused by the piling or plowing of snow. Personal injuries or death resulting from slips, falls, or other accidents. Snow remaining due to parked cars. Vehicles parked in areas that could create hazards or impede snow removal work, even if the Client has informed Contractor of vehicle placement. Ice accumulation on driveways, steps, or walkways caused by drainage. Snow removal from driveways, steps, or walkways caused by roof clearing. Scraping or stains left from blowing, shoveling, or removing snow from pavement. Chipping due to uneven concrete, lips, edges, or other surface irregularities. Contractor will not drive through low-hanging branches. If an object overhangs the driveway and touches equipment, that portion of the driveway will not be serviced until the issue is resolved.

Property Damage: The Client must report any property damage caused by the Contractor in writing within 96 hours of the incident. Contractor will repair any property damage reported within this timeframe. Contractor is not responsible for any damages caused by ice or snow buildup that remains on the property. This includes, but is not limited to, plow trucks or tractors slipping and sliding on ice. In such cases, the Client is not responsible for damages to the Contractor's property (trucks, plows, blowers, etc.). If property damage is not reported timely and properly, the Contractor will have no obligations, and the Client waives any right to damages.

Blizzard Clause: The Contractor reserves the right to limit services during; severe cold, poor visibility, or times when local government plows are taken off the roads.
​
Hazard: The Client understands that snow removal may not completely clear the Property to bare pavement, and slippery conditions may remain even after services have been performed. If the Client or Contractor deems any area to be particularly hazardous, the Client should apply salt. Contractor is not responsible for any death, injury, loss, or damage to persons or property resulting from the non-performance of our obligations in this agreement. The Client agrees and understands that the Contractor reserves the right to stop working in severe conditions (without penalty) to avoid unsafe conditions. The Client also agrees to waive any right of subrogation against Liberty Lawn and Snow due to such circumstances.
Licensure: Contractor represents that it and its agents will maintain proper licensure for the services provided.

Insurance: The Contractor maintains General Liability Insurance and workers' compensation coverage.
​
Force Majeure: Contractor shall not be held liable for delays, damages, personal injuries, or other claims that are the result of events or circumstances beyond its reasonable control, including but not limited to weather, war, acts of terrorism, vandalism, strikes, material shortages, or acts of persons other than Contractor's personnel or agents.

Termination: This agreement is cancelable at any time with a 7-day notice by either the Client or Contractor. Mid-contract cancellations will result in a pro-rated refund. Refunds will be figured at $60 per service visit completed.
​
Auto-Renewal: For your convenience, all services automatically renew annually unless canceled.
​
Acceptance of Terms: The above contract link is provided in all snow quote emails. Entering the contract above does not require signature capture. Client agrees that accepting an estimate and/or e-mail correspondence requesting snow removal service are considered valid and legal acceptance of terms listed in the above contract.

Please Note:

Services not included (drifting, smaller events, windrows from <6" snowfalls, or out of contract range requests) will be offered at a discounted rate when you in a corresponding year contract.
